These General Terms and Conditions shall take effect on 01/06/2020. This version cancels and replaces the previous versions.

Article 1. Definitions and scope of application

1.1 Definitions

The definitions below shall have the same meaning whether used in the singular or plural.

"On-site activities" refers to the provision of tickets for events, activities or tourist attractions at your destination, such as concerts or guided tours.

"Exceptional and Unforeseeable Circumstances" refers to a situation beyond the control of the party invoking such a situation, and for which the consequences could not have been avoided even if all reasonable measures had been taken.

"Package Holiday" means the combination of two or more different types of travel arrangements for the same trip or stay that exceeds twenty-four hours or includes an overnight stay, if: 

1º these services are combined by a single professional, including at the traveller's request or based on their choice, before a single contract which includes all these services, is signed; 

2º regardless of whether any separate contracts have been signed with individual travel service providers, these services are: 

  1. a) Purchased from a single point of sale and chosen before the traveller agrees to pay; or
  2. b) Offered, sold or invoiced at an all-inclusive price or at a total price; or
  3. c) Advertised or sold under the description "package" or similar term; or
  4. d) Combined after a contract has been agreed to and where the traveller is given the option by the professional of choosing from a selection of different kinds of travel service; or 
  5. e) Purchased from separate professionals through linked online booking procedures, where the name of the traveller, payment terms and email address are transmitted by the professional with whom the initial contract was agreed to one or more other professionals, and where a contract with the latter(s) is concluded no later than 24 hours after confirming the booking of the first travel service.

"Travel Service Provider" refers to suppliers who make available the Services - for example, airlines, accommodation services, car rental companies, "On-site Activity" service providers or package providers (i.e. Bey Tours but only when acting as a package travel operator).

"Third Party Suppliers" means all Travel Service Providers except Bey Tours, (i) whether they make the Services available to the User directly or (ii) they fulfil the Services where Bey Tours is in charge of making such Services available to the User.

 

"Service" refers to any service offered on the Website, such as transport services, accommodation services, car hire services, linked travel arrangements, tourist packages, On-Site Activities and associated payment services, where applicable.

"Travel Services" means any service provided on the Website, including the booking of transportation services, accommodation services, car rental, linked travel arrangements, tourist packages, on-site activities, which are provided by Travel Service Providers.

"Linked Travel Arrangement" refers to the combination of at least two different kinds of travel arrangements purchased for the same trip, covering at least a 24-hour period or one overnight stay, which does not constitute a package, and leads to separate contracts concluded with individual travel service providers, if a professional facilitates: 

1º the separate choice and separate payment for each of the travel arrangements made by the traveller during a single visit to their point of sale or during a single interaction with them, or 

2º the targeted purchase of at least one additional travel service from another professional if the contract with this other professional is agreed at the latest 24 hours after confirming the booking of the first travel service. 

When only one of the types of travel service mentioned in sections 1°, 2° or 3° of the below definition of "Travel Arrangements", and one or several of the tourist services mentioned in section 4° are purchased, this does not constitute a Linked Travel Arrangement if these services do not represent a significant part of the combined value of the services and are not advertised as a key feature of the trip or do not in any way constitute such a feature. 

"Travel Arrangements" refer to:

1° The transportation of passengers; 

2º Accommodation that is not an integral part of passenger transportation and has no residential purpose

3° The hire of cars and other category M vehicles, as specified in Article R. 311-1 of the French highway Code as having a maximum design speed exceeding 25 km/h, or motorcycles as specified in Article R. 311-1 of the Highway Code for which a category A driving licence is required, in accordance with the provisions of Article R. 221-4 of the same Code; 

4° Any other destination service that is not an integral part of a travel service covered under sections 1°, 2° or 3°. 

Combinations of travel arrangements in which only one of the types of travel service mentioned in sections 1°, 2°, or 3° above is combined with one or more of the tourist services mentioned in section 4° above do not constitute a package if the latter services: 

1° Do not represent a significant part of the value of the combination (a significant part corresponding to 25% or more of the value of the combination), are not described as an essential feature of the combination or do not in any way constitute such a feature; or 

2º Are selected and purchased only after the fulfilment of a travel service mentioned in 1º, 2º or 3º above has begun. 

"Website" refers to www.beytours.pro .

“User” means any user of the Website who browses, becomes aware of, reserves and/or buys one or more of the Services offered on the Website.

 

1.2 Scope of application

These General Terms and Conditions of Sale (hereinafter the "General Terms and Conditions"), the confirmation of your booking and the applicable Specific Conditions govern the conditions under which the Travel Service Providers offer you Services. When you book a Service using the Website, you will enter into a contractual relationship with the relevant Travel Service Provider for that Service.

The availability of the Services made by Bey Tours and the Third Party Suppliers on the Website is reserved for the sole Users who acknowledged all General Terms and Conditions and agreed to them by ticking the box or clicking on the hyperlink provided for this purpose. Without this acceptance, it is technically impossible to continue in making a reservation.

Accordingly, the completion of the reservation process on the Website is deemed explicit acceptance by the User of these General Terms and Conditions.

The User acknowledges and accepts that Bey Tours offers him/her a service of intermediation, booking and, where applicable, payment of Travel Arrangements. Thanks to this service for which the User enters into an agreement with Bey Tours, the User is put in contact with the Travel Service Providers.

The offer and supply of Services, under the same terms as General Terms and Conditions, are also governed by the specific conditions of the Third Party Suppliers (hereinafter "Specific Conditions"), including, inter alia, the specific conditions of airlines and accommodation services. It is the responsibility of the Users to familiarise themselves with the applicable General Terms and Conditions and the Specific Conditions. The Specific Conditions of the airline services will be available before any booking and the Specific Conditions of the relevant Third Party Suppliers can be reviewed here : beytours.com. The Specific Conditions of Third Party Suppliers for accommodation services, car rental or on-site activities are displayed before finishing the reservation process.

The General Terms and Conditions and Specific Conditions may be modified respectively by Bey Tours and by the Third Party Suppliers at any time without prior notice, it being understood that such changes will not be applicable to the reservations of Services made previously. It is therefore essential that the User consults, accepts and saves and/or prints the General Terms and Conditions at the time when they make a reservation, particularly in order to check the provisions that are in force.

Article 2. Booking on the Website

2.1 Capacity — Use of the Website

The purpose of the Website is to assist the User in the search for Services relating to travel and tourism, to make suitable reservations and to finalise any transaction related with Travel Service Providers. The User must be at least 18 years old and legally capable of entering into a contract and using the Website in accordance with both the General Terms and Conditions and the Website's General Terms and Conditions of Use, which can be found here.

Except in cases of fraud where it is up to the User to provide proof, the User is financially responsible for their actions on the Website, particularly for any use made of their User name and password. The User also declares the information provided about them on the Website to be truthful and accurate.

Fraudulent use of the Website or use that contravenes to the present General Terms and Conditions will be grounds for denial of the User’s access, at any time, to the Services proposed by Bey Tours and/or its Third Party Suppliers or other features of the Website.

2.2 How our sort order is determined

Users have many options to help them find the perfect accommodation, flight, car hire or the ideal activity. The "sort" settings allow the User to categorise search results according to their preferences, whether they are based on price, the review score or other criteria. The "filter" settings allow the User to include or exclude different options to suit their needs. If no options are selected, we will display a range of relevant options in the search results, based on the criteria outlined below:

  • Accommodation: our default order reflects the relevance of the accommodations to your search criteria, as we want to make sure that you can easily and quickly find the offer that best suits you. To establish their relevance, we take into account factors such as the location of the accommodation, its review scores based on consumer reviews, the popularity of the accommodation (measured by the number of Users on our sites making bookings at that accommodation), the quality of the content provided by the accommodation supplier, the competitiveness of its rates and its availability, in comparison with other properties meeting your search criteria. The compensation paid to us by an accommodation provider for bookings made via our sites is also a factor for the relative ranking of accommodations with similar offers, based on the relevance criteria described above. For sorting that is not by default (e.g., by price or number of stars), accommodations with similar results will be ranked based on the above criteria.
  • Flights: our default sort order is based on the lowest price. In cases where several flights have the same price, the shortest flight will be listed first.
  • Car hire: our default sort order is primarily driven on price.
  • Activities: our default ranking is manually carried out by Bey Tours' destination managers who are familiar with each market, taking into account factors such as price, popularity, distance from the accommodation and customers feedbacks.
  • Package Holidays: when combining several tourist products into a single package holiday, we use the criteria outlined above to determine the sort order for each product.

In addition, we are constantly optimising our services to provide the best possible Users experience. Accordingly, we may test various default sort order algorithms from time to time.

2.3 Formalities (passport, visa, administrative and health regulations, etc.)

The User can find all relevant information here : beytours.com and here : beytours.com for any necessary administrative and/or health formalities for the trip. It is up to the User to take note of these and the consent of the User to the terms of the General Terms and Conditions will be taken as recognition of the fact that the User has effectively acknowledged them.

International travel: the User will be responsible for ensuring that they comply with the requirements for entry to a foreign country and that their travel documentation, such as passport and visa (in the context of transit, business travel, tourism or other) are in order and that all the requirements for entry into the territory are met. We invite our Users to consult the prohibitions of travel, warnings, advertisements and advice published by the governments in question before booking a travel to international destinations.

The User is responsible for the fulfilment and any costs arising from these formalities for police, customs and health requirements required for his/her travel such as passport, national identity card, residence card, parental authorisation, visa, medical certificate and vaccinations.

We draw your attention to the fact that the regulatory requirements in some countries require passports to be valid for more than 6 months after the date of entry to the territory. If the User’s passport is in the last year of validity, the User is advised to check the requirements of the destination country before finalising travel plans. The name on the passport must be identical to the name indicated on the ticket, otherwise the User will not necessarily be able to travel and the insurance may not work. If, after having booked a stay but before departure, one of the passengers changes name (for example, as a result of a marriage), the User must inform Customer Service by calling 01.40.22.04.20 (+33.1.40.22.04.20 from abroad). Furthermore, it is essential that children aged 15 years or over have identity documentation in their own name.

For any information concerning visas, Users are advised to contact the embassy of the country that they intend to visit. We remind you that obtaining a visa can take time and Users are advised to leave sufficient time to obtain one. The conditions for obtaining a visa may be subject to changes and you must ensure that you have obtained up-to-date information before your reservation and departure.

We assume no responsibility if you are refused entry onto a flight or into a country due to your inability to present the appropriate passport, visa or other travel documents required by any airline, authority or country, including countries through which you merely transit. That includes all stops made by the aircraft, even where you do not disembark from the aircraft or leave the airport.

While the majority of travel, particularly to international destinations, is conducted without incident, travels to certain destinations may involve higher risks than others. Bey Tours asks passengers to consult travel bans, warnings, advertisements or advice published by the relevant authorities prior to booking travel to international destinations. Information relating to conditions of different countries, as well as the level of risk associated with the journey to certain international destinations can be found at the following website:

By offering travel products to certain international destinations, Bey Tours does not declare or guarantee that travel to such areas is recommended or that it poses no risk.

All passengers wishing to enter or transit through the United States under the Visa Exemption Program must apply for authorisation to travel through the Electronic System for Travel Authorization (ESTA). Please provide sufficient time to complete your ESTA application. It is recommended to make the request at least 72 hours prior to departure. For further information, please consult the website of the US Department of Homeland Security: https://esta.cbp.dhs.gov/esta/

A number of governments are introducing new requirements for air carriers on providing personal information about all passengers on the aircraft. The data will be collected at the airport when the User checks in or during the booking process. Therefore, the User is advised to provide additional time to complete registration for the flight.

Between the appearance of information on the Website and the date of departure of the User, it is possible for certain changes to occur. We therefore recommend that the User consults the Website immediately prior to departure.

Health: recommendations in terms of vaccinations may change and we advise you to consult your doctor to be aware of the current recommendations before departure. It is your responsibility to ensure that you comply with entry conditions related to health, that you obtain the recommended vaccinations, that you take any medication required and that you follow all medical advice related to your journey. Medical advice for travellers can be found at http://www.pasteur.fr/fr/map. For all medical advice related to your stay, please contact your doctor.

Disinfection: while this is not common, the vast majority of countries reserve the right to disinfect the aircraft in the event that any threat to public health, agriculture or the environment is discovered. The World Health Organisation and the International Civil Aviation Organisation have approved the following procedures for disinfection: (1) spraying the passenger compartment of an aeroplane with an insecticide aerosol whilst passengers are on board the aeroplane and (2) treating the internal surfaces of the aeroplane with a residual insecticide, when no passengers are on board. If, in particular due to non-compliance with these administrative and health requirements, the User is unable to depart on the relevant date, the price paid cannot under any circumstances be reimbursed.

In the event of the loss or theft of a ticket, the User must complete the relevant statement to the police and the airline and acquire another ticket from the issuing Third Party Supplier; only the Specific Conditions of applicable Third Party Supplier may cover refunds.

2.4 Making, changing and cancelling bookings (subject to Articles 3.1, 3.2, 3.3, 3.4 and 3.5, if applicable)

Confirmation of the booking, which summarises the essential elements, such as the name(s) of the Service(s) booked and the price, will be sent to the User by email, post or fax within a maximum of 1 working day following the date of reservation.

Bey Tours is not responsible for booking errors that are attributable to the User or that are caused by exceptional and unforeseeable circumstances.

All conditions for cancellation, possible rectification and/or reimbursement are directly accessible on the Site prior to reservation and, if applicable, are listed on the booking confirmation.

Any cancellation or modification request can be made by phone by contacting Customer Service on 01.40.22.04.20 (+33.1.40.22.04.20 from abroad) or online directly via the Website. Please note the User may, under no circumstances, make a request for modification or cancellation by letter or email. All such requests shall be dealt with on behalf of the Travel Service Providers concerned. The Users have the right to cancel or modify the Services and cancellation or modification fees may be applied by Third Party Suppliers depending on the circumstances, in accordance with their Specific Conditions (which will be made available to the User before the reservation).

In the event of total or partial cancellation of the reservation by the User, the User may be required by Third Party Suppliers to pay cancellation fees to cover the cost of travel arrangements that have already been made - please consult the Specific Conditions notified during the booking process for more information. When the cancellation involves more than one person on the reservation, all applicable cancellation fees shall be imposed respectively on each person involved in the reservation. In some cases, compensation for the cancellation payable to Third Party Suppliers may consist of the total amount of the travel reserved; the User will receive no repayment in this case.

All cancellation requests will be processed by Bey Tours on behalf of the relevant Travel Service Providers. If the User does not turn up to travel, all possible reimbursements due to the User will be paid in accordance with the applicable Specific Conditions, which the User is advised of during the booking process.

In the event, you decide to “pay later”/ pay at the property and you do not show up or cancel the booking, the property may impose a no-show or cancellation fee (the detail of any fee will be notified to you as part of the booking process). In this event, either the property or Bey Tours (or its affiliates) will charge the property’s no-show or cancellation fee in the  property’s local currency.

If the User wishes to cancel all or part of a booking, a cancellation administration fee will be applied by Bey Tours in addition to any cancellation fees imposed by the relevant Third Party Supplier. Please refer to the table below for applicable fees:

Bey Tours reserves the right to cancel your booking if the full payment is not received by the dates specified in the contract.

If after confirming the booking, the User wishes to change their booking (change of departure or return date, schedules, destination, accommodation), fees may be applied by the relevant Third Party Supplier up to the total value of the trip that was initially booked, and the User will be required to pay the cost of a new booking. Please refer to the Specific Conditions provided during the booking process.

In addition, if the User wishes to change all or part of the booking, and if such changes are authorised by the relevant Third Party Supplier, administrative modification fees will be applied by Bey Tours in addition to any change penalties imposed by the relevant Third Party Supplier. Bey Tours (and the relevant Third Party Supplier) reserves the right to cancel the User's booking if full payment for any change fees that may be applicable to the booking is not received by the dates outlined in the contract.

Hence, the reimbursement of airline tickets will only be granted with the prior agreement of the Travel Service Provider concerned.

In addition, in case of reissue of the ticket or of a new reservation after a cancellation or modification by the User, it is stipulated that the price of the new ticket or the new booking may be higher than that of the first reservation, and that administrative costs may be invoiced by Bey Tours in this instance, in accordance with the terms of this clause.

In the event of a reimbursement granted to the User, the sums already paid will be transferred (by Bey Tours or the Third Party Supplier, where applicable) to the corresponding account of the bank card used in the booking.

In any event, in the case of cancellation made by the User, with the exception of the case of force majeure, the charges levied initially by Bey Tours will not be refunded.

In relation to transport and tourist packages, delays in the air, rail or overland pre-transport, that is not included in the purchased package, resulting in check-in being missed is not an exemption condition for the User of the financial conditions of cancellation provided for in these General Terms and Conditions.

In the case of an invalid air ticket or if the latter has not resulted in transport, the User may be reimbursed for the taxes and fees included in the cost of the ticket purchased, which are based on the actual boarding of the User.

You may request a refund of certain airport taxes and charges collected by airlines, within 30 days of the date of flight, if the ticket is no longer valid and has not been used - contact contact@beytours.com for further details.

These fees and charges shall be reimbursed no later than 30 days from the date of receipt of the request for reimbursement from the User, which may be sent to the following email address: contact@beytours.com.

The User may be charged a handling fee in the event of a request made by any other means, up to a limit of 20% of the amount reimbursed to the User for this reason. In any event, the User can only obtain repayment once and the reimbursement shall be subject to the Specific Conditions of Third Party Suppliers concerned, within the limit of the amounts authorised by the Third Party Supplier.

2.5 Granting and withdrawal of travel documents

Travel documents issued in respect of a Service ordered through the Website are sent out to the place of delivery indicated by the User during the booking, in accordance with the provisions laid down for each type of Service available on the Website prior to the reservation or under the Specific Conditions.

The time limits specified in the booking for submitting travel documents shall be the average times corresponding to delivery to an address in mainland France. These time limits may not exceed 5 working days from the date of the booking and payment.

If the delivery of travel documents is made impossible because of an error made by the User in entering contact details or by failure to indicate the existence of an internal phone system or digital code, neither the Third Party Supplier(s) concerned or Bey Tours will be responsible.

The User's attention is drawn to the fact that no travel documents will be provided by post abroad or in the overseas French departments and territories. Travel documents can only be delivered by post to mainland France.

2.6 Evidence

It is expressly agreed that, except for a clear error on the part of the Third Party Suppliers or Bey Tours which the User would provide proof of, the data stored on the Bey Tours computer system and/or that of its Third Party Suppliers will be legally valid in terms of any reservations made by the User. Any data in electronic or digital support comprise valid proof and as such are acceptable under the same conditions and with the same legal validity as any document that will be prepared, received or held in writing.

2.7 Cooling-off period

The User is advised that, pursuant to Article L. 121-21-8° of the French Consumer Code, the Services offered through the Website  are not subject to the application of a cooling-off period as set out in Articles L. 121-21 et seq. of the French Consumer Code in respect of distance selling.

Accordingly, Services booked through the Website will only be subject to the conditions of cancellation and modifications contained herein and/or in the applicable Specific Conditions of Third Party Suppliers.

Article 3. Details of Services

The purpose of this Article is to offer details on the conditions applicable to the Services provided by the Travel Service Providers for the information of the User. These details are not exhaustive and do not replace the applicable Specific Conditions. In the event of any conflict or inconsistency between the General Terms and Conditions and the Specific Conditions which form an integral part of the General Terms and Conditions, the Specific Conditions in question take precedence. The User can consult the Specific Conditions prior to finalising a reservation.

Bey Tours makes Travel Arrangements available through the Website, in particular package holidays, linked travel arrangements, flight tickets, accommodation services, car hire and On-site activities. Bey Tours acts on behalf of various Travel Service Providers (accommodation services and/or transport providers).

Unless otherwise provided by law, this detail of the Specific Conditions applicable to the services provided by the Travel Service Providers cannot in any way be a source of commitment or liability for Bey Tours.

3.1 Air transport services

Air transport services are offered either as part of the package holiday, as part of a linked travel arrangement, or as a stand-alone service.

 

3.1.1 Conditions of travel

The conditions for the execution of air transport shall be governed by the applicable Specific Conditions of the Third Party Suppliers (in particular the conditions of transport and the fare conditions). Specific Conditions may include restrictions and/or the costs related to the cancelling or modification of a reservation. The Specific Conditions of Third Party Suppliers providing the air transport services are available before completing the reservation and the specific conditions for each Third Party Supplier may be consulted here : beytours.com. When the User directly pays Bey Tours for ordering airline tickets, Bey Tours acts in the capacity of the authorised representative of the Third Party Supplier providing the air transport services. This means that the User enters into a contract for these air transport services with the Third Party Supplier. The latter therefore bears the liability of the air transportation contract. The Specific Conditions of Third Party Suppliers, air carriers can be consulted here : beytours.com .

The prices and charges associated with certain low-cost or "low-cost" flights from outside France may be displayed in another currency (e.g. GBP); in such cases, we will provide you with an estimate in Euros. The amount actually invoiced by the "low-cost" airline may vary slightly due to the variable exchange rates applied by the various credit card issuers. In addition, your bank statement may also include a transaction fee applied by your card issuer for processing the transaction. Bey Tours is not bound by these additional fees and cannot be held responsible for any fees associated with variable exchange rates and fees charged by card issuers.

When you search for flights on this Website, for some flights, you may be redirected to the website of the airline, Third Party Supplier, to finalize your reservation and make your payment. Your contract for such a reservation is concluded directly with the Third Party Supplier. Bey Tours is not associated with such reservations and is not responsible for them.

3.1.2 EU Community List

In accordance with European regulations, details of airlines that are prohibited from operating within the European Community are available at http://ec.europa.eu/transport/modes/air/safety/air-ban/index_en.htm.

It is the responsibility of the User to comply with the instructions of the Travel Service Providers, and in particular regarding times for checking in. It is advisable to check-in at least three hours prior to departure for international flights, and at least two and a half hours for domestic flights. In particular, the User acknowledges and accepts the following:

  • Bey Tours has no control over the allocation of seats on a flight, even when it has been reserved with the airline and does not give any guarantee that certain seats will be available on the day of departure;
  • Bey Tours has no control over the information relating to the hours spent in the aircraft as provided by the Third Party Supplier supplying the air transport service; this information is provided only for the purposes of information and may be modified and confirmed;
  • It should be noted that for the return flight, irrespective of the type of flight, on premises confirmation is often required by the airline of the return flight, at least 72 hours before the due date. It is the responsibility of the User to confirm their return flight in accordance with the requirements of the Third Party Supplier providing the air transport. In the case of ‘open’ returns, it is advisable to book the return flight as soon as possible.
  • If the User books a return flight without using the outward part, the airline may, in certain conditions, cancel the return flight without any reimbursement. The same shall apply if the return flight has not been taken, and therefore the journey is not been completed out at all. The User must use their flight tickets in chronological order. Please refer to the Specific Conditions of the airline concerned for more information on this point.
  • In the event of special or charter flight, the name of the airline, timetables, the type of aeroplane, the route and any potential intermediate stops are provided purely for information purposes on return flights of the travel.
  • Additional fees can be passed on by certain air carriers in respect of meals, baggage, seat reservations, etc. Bey Tours shall not be responsible for those costs and the information on these costs mentioned on the Website is given for the purpose of information only, and may be modified by the airlines at any time.

The name of the airport, where the city served contractually consists of more than one place, is for information purposes only and may be subject to change.

The User’s attention is drawn to the need to provide for a period sufficiently large taking into account any delays in the case of a reservation on the Website for a journey including a connection or transfer, in particular, when the latter consists of a change of airport.

It is noted that airlines sometimes refuse boarding to pregnant women where they consider that, as a result of the term of the pregnancy, there is a risk of premature birth in flight. The User must comply with all Specific Conditions applicable to air transport services concerning the transport of pregnant women.

The User must comply with all Specific Conditions applicable regarding the transport of children. Children under 2 years of age will not have a seat on the aeroplane unless the parents ask to pay for a seat especially for them. The User's attention is drawn to the fact that this provision shall be valid only on condition that the child is younger than 2 years for the entire period of the journey, on the date of departure and the date of return. In effect, airlines consider that children over the age of 2 years on the date of return should have their own child-fare return ticket. The costs incurred due to non-compliance with this rule will not be reimbursed.

Children under 14 years old who are not accompanied will only be accepted on the flight in accordance with the Specific Conditions applicable to air transport services.

Children aged 14 years and over must have identity documents in their own name.

3.1.3 Special fares

The User's attention is drawn to the fact that a number of airlines have special fares for infants under 2 years old, children and elderly persons. These reductions depend on the airline and the flight concerned, the availability of seats, as well as the age of the passengers.

If the User has benefited from a discount, any corresponding special fares appear in the price summary table prior to confirming the booking.

In addition, it should be noted that the child fare reduction is not automatically applied to the adult fare offered by the airlines. The percentage of the reduction in the child fare is subject to variation according to the adult fare applied by the airline for the flight in question. It is therefore possible that the child fare may be the same as the adult fare listed on the Website.

3.1.4 Air carrier liability

It is noted that the liability of carriers is most often restricted by national or international laws applicable to them, or by their own Specific Conditions. In terms of air transport, a summary of these conditions is provided to the User with travel tickets.

3.1.5 E-ticket

An electronic ticket is a ticket with no physical form. When using this type of ticket, the User must go to the check-in desk of the airline concerned with valid travel documents (passport, visa, identity card etc.), in order to obtain a boarding card. The User should therefore comply with the time limits stipulated for checking in.

3.1.6 Combination of one-way tickets

Bey Tours occasionally offers Users the option of making a reservation with a combination of two one-way tickets instead of a return flight. The combination of two one-way tickets can offer a wider choice of airline tickets, which are often less expensive and may be tickets from one airline or from two different companies.

Unlike return tickets, each one-way ticket is subject to its own rules, limitations and costs. More specifically, if the reservation completed by the User contains a combination of two one-way tickets booked through two different airlines, each of these tickets will be bought by the User according to a specific contract with the Third Party Supplier concerned and will be subject to the Specific Conditions of each Third Party Supplier concerned. The Specific Conditions of the Third Party Suppliers providing the air transport services will be available to the User prior to completing the booking and the Specific Conditions of each relevant Third Party Supplier can be reviewed here : beytours.com .

If one of these two flights is amended by the airline (e.g. cancellation or delay), thereby requiring the User to amend his or her other flight ticket, the User shall have sole responsibility for the payment of costs related to modifications to the flight ticket.

3.2 Accommodation and holiday services

These Services are offered either as accommodation-only services, as part of a package holiday (cf. Article 3.5), or as part of a Linked Travel Arrangement.

With the exception of accommodations for which payment is made during the stay (cf. Article 3.2.8), all accommodations are made available by Bey Tours (whether they are booked separately or in a Package) in accordance with Articles 3.2, 3.5 and with the Specific Conditions applicable, as displayed before finalizing the booking. The Specific Conditions applicable can set terms and/or cancellation/modification fees imposed by the relevant Third Party Supplier. 

3.2.1 Trip duration

The date of departure and the date of return journey are included in the duration of the stay. The first and/or the last night may be shortened by a late arrival or morning departure.

If the User does not show up on the first night of the overnight stay and plans to check in for the following nights in the reservation, the User should confirm the changes made to their reservation with Bey Tours no later than the initial check-in date to avoid cancellation of the entire reservation. If the User does not confirm the modifications made to their reservation with Bey Tours, the entire reservation may be cancelled and any potential reimbursements will be payable to the User on the condition that they agree with the applicable Specific Conditions, as specified during the booking process.

Any User who does not cancel or modify their reservation before the end of the cancellation period of the accommodation concerned, (which may vary depending on the accommodation and is specified in the booking process) before the date of arrival onwards, they will be subject to the fees provided for in the Specific Conditions applying to reservations. Users are reminded that certain hotels do not provide the option to modify or cancel a booking once it has been made and these limitations are available in the Specific Conditions of the reservation at this accommodation.

3.2.2 Room occupancy

It is noted that most often rooms are only available from 2 pm onwards and they must be vacated before 12 pm, regardless of the planned arrival or departure time of the transport mean used.

Single rooms generally include a bed for one person. These rooms are often subject to an additional cost. Double rooms are provided with either two beds or, more infrequently, a double bed.

3.2.3 Group bookings

You may not book more than 8 rooms online for the same accommodation and the same dates of stay. If we find that you have booked more than 8 rooms in total by using different bookings, we reserve the right to cancel your booking and to invoice you for any cancellation fees as the case may be. For payments of a non-refundable security deposit, it may not be possible for you to be reimbursed.

If you wish to book 9 or more bedrooms, you must select "9+" from the "Travellers"/ "Rooms" drop-down menu in the accommodation search window and contact Bey Tours agents by filing in the online group travel form. One of our agents who specialises in group travel will assess your request and will contact you about confirming the booking. You may be requested to sign a contract, and/or to pay a non-refundable security deposit.

Those provisions apply to group bookings, whether made separately from the booking of another tourist product, or as part of a tourist package.

3.2.4 Classification

The indication of the level of comfort allocated to hotels in the hotel description available on the Website corresponds with a rating based on the domestic standards of the host country, and may this vary from French standards. This is purely for information purposes.

It may sometimes be the case that, for technical reasons (e.g. a hotel has had overbooking due to communications issues with the hotel), force majeure (e.g. hotel closed due to a hurricane) or due to the action of a third party (e.g. a room reserved is unavailable for reasons of hotel maintenance), a hotel reservation is cancelled or amended. In such cases, Bey Tours will make all reasonable efforts to inform the User as soon as possible and, where possible, provide an alternative accommodation in a hotel with at least the same rating as well as equivalent services. If the User declines the alternative offered, Bey Tours will ensure that all amounts paid by the User for the booking will be reimbursed. If applicable, for example, where a technical problem for which Bey Tours is responsible results in cancellation or modification or a reservation, directly causing a loss to the User, Bey Tours will pay reasonable compensation to the User.

3.2.5 Activities

From time to time certain activities offered by the Third Party Suppliers and indicated in the description displayed on the Website may be deleted particularly due to reasons of weather, force majeure, low-season travel or when the number of participants required is not reached.

The cancellation of any activity due to force majeure will not, in any event, result in any compensation payable to the User.

For tours, the order of site visits is given by way of indication only, and may be amended by the Third Party Suppliers.

3.2.6 Meals

The number of meals included in the tourist package depends on the number of nights stayed. Full board includes breakfast, lunch and dinner. Half-board includes breakfast and either lunch or dinner according to the package. Full board and half-board begin with the meal before the first night of the stay and end with breakfast following the last overnight accommodation.

It is noted that, unless otherwise stated in the tourist package description on the Website, beverages are not included in the meals and are at the expense of the User. Where tap water is not suitable for drinking, expenditure on the purchase of bottles of water is borne exclusively by the User.

Parents are asked to bring suitable food for infants with them as they may not find it locally.

3.2.7 Local taxes

Please note that some additional taxes may be imposed by the local authorities in some States (tourist tax, occupancy tax, etc.). These additional local taxes, where they exist, are to be borne by the User. These taxes will be collected from the User either by Third Party Suppliers or by Bey Tours if the applicable regulation so requires.

3.2.8 Information regarding direct payments and payments during the stay

For providing basic accommodation, reserved by the User outside of any tourist package, the User may have the option to ‘pay now’ or ‘pay later / pay during your stay’.

If the User chooses the payment option ‘pay now’, the Service is made available to the User by Bey Tours and the amount of the reservation shall be immediately deducted by Bey Tours from the payment method chosen by the User, in the currency chosen.

If the User chooses the option "pay later/pay during your stay", the terms under which the payment shall be made (when and how) will be displayed during the online booking process (including the requirement or not to pay a security deposit and the related payment calendar) and the amount of the reservation shall be paid to the establishment in the currency of the country of that establishment (additional commissions on the amount of the transaction could be charged by the bank or the supplier of the User’s payment method). When the payment option selected for a standalone accommodation booking is the option "pay later/pay during your stay", the Third Party Supplier makes the Service available to the User directly. The User enters into a contractual relationship with the Third Party Supplier, which is responsible of operating the Service towards the User. For these transactions, Bey Tours will act as an interface between the User and the Third Party Supplier (but not as a payment intermediary): Bey Tours will transfer the details of your booking to the relevant Third Party Supplier and will send you a confirmation email on behalf of the Third Party Supplier. The accommodation bookings will require information related to your credit card to secure the booking and the cards can be validated or preauthorized in accordance with Article 4.

In addition to the other taxes and charges which the User could be liable to pay, as set out in the General Terms and Conditions, additional fees may be applied depending on the User’s method of payment. Please note that some accommodations may require a deposit which may not be refunded (refer to the applicable Specific Conditions). The amount of the taxes and the exchange rate may vary over the period between the reservation and the stay. Foreign exchange fees for payment in a foreign currency may also be applied by the issuer of your payment card. Tickets issued by Bey Tours are therefore valid only for ‘pay online now’ reservations.

 

3.3 Vehicle rental services

The car hire service is provided either in the context of a Package by Bey Tours or on a standalone basis by the relevant Travel Service Provider. These Services, booked separately or within a Package, are ruled by the Specific Conditions of the Third Party Suppliers and by the provisions set out in Article 3.5 of the General Terms and Conditions.

3.3.1 Payment methods

When collecting the vehicle, the User and the main driver must provide a valid credit card registered in their own name.

In addition, the Third Party Supplier will require a pre-authorisation from the User's bank, which will be held as the security deposit retained by the Third Party Supplier. The User and the main driver shall then contact their bank to confirm their credit limit for the account that this security deposit is applied to. For larger vehicles, two credit cards may be required.

If the User does not comply with the rules set out in this section, the Third Party Supplier may refuse to provide a vehicle to the User.

The User must verify which credit cards are accepted by the Third Party Supplier in the applicable Specific Conditions as some cards, such as Electron cards, are not accepted. The applicable Specific Conditions can be consulted prior to completing your order through an interactive window.

3.3.2 Additional fees

Additional fees may be applied on-site, such as refuelling charges upon return of the vehicle, additional driver fees, young driver fees and charges related to the delivery/collection of the vehicle. The User acknowledges that neither Bey Tours nor the Third Party Supplier shall be held liable of such additional fees. The User's attention is drawn to the fact that, for car hire in mainland France, Third Party Suppliers charge additional fees in the even of using the vehicle in Corsica.

Even when mandatory insurance is included in the price of the car hire, an excess may also be applied in the event of theft or damage to the hire vehicle. This may vary depending on the Third Party Supplier, the country of rental and the type of vehicle hired. The purchase of optional complementary insurance coverage (called "super CDW" or "super TP") may reduce/remove the applicable excess. The User is solely responsible for their decision to opt in or out of the optional coverage. Bey Tours and the Third Party Supplier cannot be held responsible for additional fees in the event of damage and/or for taking out optional coverage.

Fuel is generally not included in the hire costs. For car hire in certain countries, some Third Party Suppliers automatically charge for a full tank of fuel when the vehicle is returned.

In addition, certain Third Party Suppliers set additional costs in the case of using snow tyres. Please consult the applicable Specific Conditions when making your booking.

The User must return the vehicle to the same agency from which they collected the vehicle, otherwise, the Third Party Suppliers will charge additional fees.

Specific equipment, such as child seats, may be requested and is payable directly to the Third Party Supplier upon vehicle picking up (subject to availability). Users are advised to confirm any requests for child seats directly with the relevant Third Party Supplier providing the car.

3.3.3 Use of the vehicle outside of France

Drivers must typically be aged between 21 and 75 years to hire a vehicle, although this may vary from one Third Party Supplier and from one country to the next. It is the User's responsibility to verify this with the Third Party Supplier. Additional fees may also apply if the driver is under 25 or over 70 years of age. These additional fees are outlined in the applicable Specific Conditions.

All drivers must present a valid driving licence for the category of vehicle rented at the time of pick up. For international car hire, other driving licence requirements may apply. An international driving licence is required if the driving licence has not been issued in the Roman alphabet. Additional documentation, such as a passport or up to two forms of proof of name and address of the driver may also be required. Users should consult the applicable Specific Conditions for more details of all criteria applicable to the booking of the rental car.

As a reminder, certain Third Party Suppliers do not authorise the use of the hire vehicle outside of the country in which it has been rented.

3.3.4 Booking cancellation /unused rental days

Except in cases of force majeure, if the User cancels their booking less than 6 hours before the arranged pick-up time, the Third Party Supplier's cancellation fee is 100% of the cost of the service. No refunds will be issued for bookings cancelled within 6 hours of the agreed vehicle pick-up time or for unused rental days.

 

3.4 Tourism services ‘Destination services’

These Services are proposed either as standalone services by the Travel Service Provider concerned, or as part of a tourist package via Bey Tours.

The reservation of "On-site activities" services shall be governed by the present General Terms and Conditions and the Specific Conditions of the Third Party Suppliers. Where the On-site activity is part of a Tourist Package, the provisions set out in article 3.5 of the General Terms and Conditions apply.

3.4.1 Activities

From time to time certain activities offered by the Third Party Suppliers and indicated in the description displayed on the Website may be deleted particularly due to reasons of weather, force majeure, low-season travel or when the number of participants required is not reached.

The cancellation of any activity to a case of force majeure or due to the behaviour of a third party to the contract shall not in any event result in any compensation being paid to the User by Bey Tours.

3.4.2 Prices

The description of the Services provided on the Website shall specify those which, in the ‘On-site activities’, shall be included in the price quoted. The prices shall be expressed in Euros and shall be understood to include taxes, unless otherwise stated on the Website.

3.5 General rules relating to the provision of tourism packages

The Package Holidays displayed on the Website are made available by Bey Tours.

The Package Holidays are subject to the terms below as well as to the Specific Conditions of the Third Party Suppliers providing any of the services included in the Package Holiday (e.g. the airline or the accommodation service provider). The User is required to review the provisions below and the applicable Specific Conditions before making a reservation.

In the event of any differences between the provisions of this section and the Specific Conditions of the Third Party Suppliers providing any of the services included in the Package Holiday, the latter shall prevail.

3.5.1 Bookings

Package Holiday bookings are governed by Title 1 of Book II of the French Tourism Code relating to organising the sale of vacations and trips.

The provisions below apply to the booking of any Service on the Website and only apply to the following Services when they are part of a Package Holiday:

1º the booking of airline tickets or other transport tickets on regular routes; and

2º the rental of seasonal furnished accommodations.

Package Holidays are subject to availability at the time of booking, and Third Party Suppliers may refuse the booking for no other reason.

Bey Tours endeavours to ensure that the Package Holiday shown online is actually available at the time of booking and will notify the User if a selected Package Holiday is not actually available at the time of booking.

The User enters into a contract with Bey Tours after paying the price and receiving the booking confirmation sent by Bey Tours.

3.5.2 Prices

The descriptions of the Services available on the Website shall specify, for each trip, the services included in the price. The prices are given in euros and shall be understood to include all taxes, unless otherwise stated on the Website.

Please note that some additional taxes may be imposed by the local authorities in some States (tourist tax, occupancy tax, etc.). These additional local taxes, where they exist, shall be payable by the User. 

Where the tourism package includes the provision of accommodation, the price is calculated on the basis of the number of overnight stays and not the number of whole days.

As a general rule, and unless otherwise expressly stipulated, insurance services, airport services, excess baggage costs, airport transfers to and from the accommodation, visa costs, vaccinations and all personal expenditure (laundry, telephone, beverages, room service, gratuities, etc.) as well as excursions, the use of sports facilities, and more generally any benefits not explicitly mentioned on the Website are not included in the price.

In the event that the price displayed on the Website is clearly incorrect, we will notify you and seek your consent in order to charge you the correct price for the service. Bey Tours reserves the right to refuse the booking should the User refuse to pay the correct price if the pricing error was evident at the time of booking.

Bey Tours reserves the right to charge a booking fee for flight transactions made on behalf of the User. The User will be notified of any potential costs and relevant amounts before confirming the booking.

The User acknowledges and agrees that after entering into the contract, the price of the contract booked via the Website may increase.

After booking, the price of the contract may be increased if the Travel Service Provider notifies the User and provides an explanation for this increase no later than 20 days before the start of the trip, for reasons relating to a variation in:

1º the cost of passenger transportation as a result of fuel or other energy sources costs,

2º the taxes or fees for travel arrangements included in the contract and imposed by a third party not directly involved in the fulfilment of the contract, including tourist taxes, landing fees, or embarkation and disembarkation taxes in ports and airports; or

3º the relevant exchange rates in relation to the contract.

Conversely, the User is entitled to a price reduction relative to the reduction of any of the costs mentioned in 1°, 2° and 3°, which occur after entering into the contract and prior to the start of the trip.

In the event of a reduction in cost, the Travel Service Provider may deduct actual administrative fees from the refund due to the User.

In the event of a price increase of more than 8%, the Travel Service Provider shall inform the User as soon as possible of:

1° The proposed changes, where applicable, and of any repercussions relating to the price of the trip; 

2° The time frame within which the User must decide whether to accept the price increase, or reject it in favour of obtaining a refund of any monies paid in relation to the booking; 

3° The consequences of the User's failure to reply within the stated time frame; 

4° Where applicable, details of alternate services offered, as well as the relevant cost.

If the changes to the contract or the alternate service result in a lower quality of trip or cost, the User shall be entitled to an appropriate price reduction in accordance with the terms of article 3.5.9.

Bey Tours will allow the User a reasonable time period to make a decision, typically 7 days from the date of notification of the price increase. If the User does not give their decision within this period, Bey Tours will send a reminder, after which time the User may cancel the contract in favour of a refund.

If you do not accept any alternate services offered by Bey Tours and opt to terminate the contract with a full refund, you may also receive compensation for any damages suffered as a result of this termination, pursuant to article 3.5.9.

Any defaulting of payment on the part of the User, whether total or partial, will lead to the suspension of the execution of the tourism package, the resulting costs being borne by the User, without prejudice to any action which may be taken against them.

3.5.3 Cancellation and modification by the User

3.5.3.1 Cancellation by the User

Any request for the cancellation of a trip by the User must be addressed to Bey Tours, which will handle such requests on behalf of the relevant Third Party Suppliers, necessarily by telephone at 01.40.22.04.20 (+33.1.40.22.04.20 from abroad) or online directly via the Website. Please note that the User may under no circumstances make a cancellation request by letter or email.

The User may cancel the Package Holiday at any time before the start of the trip. In the event of a cancellation of the Package Holiday by the User, Bey Tours and the Third Party Supplier may require the payment of cancellation fees to cover the cost of travel arrangements that have already been made. In addition, standard cancellation fees may be imposed by the Third Party Suppliers providing each of the services included in the package which have respectively been cancelled. When the cancellation affects more than one person on the reservation, the cancellation fees shall be applied for each person on the reservation. In some cases, compensation may be the total amount of the trip reserved, with the User not receiving any repayment in this respect. Any cancellation of a part of the reservation shall be subject to the Specific Conditions of the Third Party Supplier, as notified during the reservation process.

Packages are subject to the applicable Specific Conditions and separate cancellation fees imposed by the Third Party Supplier may apply.

The User has the right to terminate the contract before the start of the trip with no cancellation fees if exceptional and unforeseeable circumstances, as defined in article 3.5.7, occurring at or in the immediate vicinity of the destination, have significant consequences on the fulfilment of the contract or on the transport of passengers to the destination. In this case, the User will receive a full refund of any monies paid under the contract. This refund will be made as soon as possible. However, no additional compensation will be paid by Bey Tours under these conditions, pursuant to article 3.5.9.

If the User fails to present themselves at the start of the trip and/or fails to use all or part of the reserved Services, reimbursement will only be granted to the User in accordance with the applicable Specific Conditions, as notified during the reservation process. The Specific Conditions of the Third Party Suppliers providing air transport services shall be made available to the User prior to finalising the booking process and can be reviewed here : beytours.com . The Specific Conditions of Third Party Suppliers providing special accommodation services shall be made available before the completion of the reservation process.

3.5.3.2 Modification of the booking by the User

Any request for changes to a trip by the User must be addressed to Bey Tours, which will handle such requests on behalf of the relevant Third Party Suppliers, necessarily by telephone on 01.40.22.04.20 (+33.1.40.22.04.20 from abroad) or online via the Website. Please note that the User may under no circumstances make a request for modification by letter or email.

The Third Party Suppliers or Bey Tours are under no obligation to grant the User's modification requests and may grant them at their sole discretion. These modification requests are subject to the availability of alternative solutions, as well as the Third Party Suppliers' Specific Conditions. The User is notified that Third Party Suppliers may impose fees for making any changes requested by the User.

In the event that Bey Tours agrees to grant this modification request, the administrative fees referred to in article 2.4 will apply, as well as any other fees imposed by the Third Party Supplier, in order to fulfil the modification request. These costs can be significant and the closer to the departure date the change is requested, the higher the fees tend to be. For example, the cost required to change an airline ticket may be nearly 100% of the ticket price.

3.5.3.3 Transfer of contract by the User

The User may assign the contract he has signed for the Travel Service providing Bey Tours has been notified, via a durable medium, at least 7 days prior to the start of the trip. Please refer to the Specific Conditions of the Third Party Suppliers concerned to obtain more information on the conditions under which the agreement may be transferred. However, Bey Tours may refuse to carry out a change of traveller if this latter does not fulfil all the conditions required for the trip.

The User and the assignee are jointly and severally liable to the seller for the payment of the balance, as well as any additional costs, fees and other charges incurred as a result of this assignment. Bey Tours will inform the assignee of the actual costs of the assignment.

Bey Tours must be notified as soon as possible of the User's wish to assign the contract. Bey Tours will endeavour to facilitate transferring the name of the travel service holder, but it should be noted that if the Package Holiday includes a flight, the airline's Specific Conditions may consider this new name designation to be a cancellation of that service and may therefore require a payment of 100% of the booking costs.

3.5.4 Cancellation and modification by Bey Tours before the start of travel arrangements

3.5.4.1 Modifications by Bey Tours

The User expressly agrees that minor changes may be made to the travel contract before the start of the trip. In this case, Bey Tours will notify the User as soon as possible.

Minor changes to the contract include: a change in the flight schedule of 120 minutes prior to the scheduled departure time or 240 minutes after the scheduled departure time, a change in airline or aircraft (if the aircraft was specified in the booking), a change in the airport of departure or arrival to one in the same region, or a change in accommodation location to one of equivalent or superior quality.

In the event that, before departure, it becomes impossible to comply with one of the key elements of the contract as a result of an external event imposed on Bey Tours, Bey Tours shall notify the User as soon as possible and provide them the option of terminating the contract with no fees, or accepting the proposed modification.

In the event that, before departure, Bey Tours is forced to make a change to one of the key elements of the contract, or if it cannot meet one of the User's particular requirements as previously agreed, it will inform the User as soon as possible of:

1° The proposed changes, where applicable, and of any repercussions relating to the price of the trip; 

2° The time frame within which the User must decide whether to accept the proposed changes to the contract, or terminate the contract in favour of a full refund of any monies paid by the User; 

3° The consequences of the User's failure to reply within the stated time frame; 

4° Where applicable, details of alternative services offered, as well as the relevant cost.

If the changes to the contract or the alternative service result in a lower quality of trip or cost, the User shall be entitled to an appropriate price reduction.

If the User does not accept an alternative service, Bey Tours shall refund all payments made by, or on behalf of the User as soon as possible and without prejudice to any compensation applicable under the conditions mentioned in article 3.5.9, unless such changes to a key element of the contract are due to Exceptional and Unforeseeable Circumstances as defined in article 3.5.7, in which case no compensation shall be payable by Bey Tours.

3.5.4.2 Cancellation by Bey Tours before the start of travel arrangements

Bey Tours may, in exceptional circumstances, be required to cancel the Package Holiday and will, in such cases, notify the User without delay. Bey Tours may (at its discretion) offer an alternative service to the initial Package Holiday, where possible. In this case, the User will be notified as to how these changes will impact the price of the booked services; if the services are of a lower quality, the User may be entitled to a reduction of the price paid under the terms of article 3.5.9.

If Bey Tours cannot offer alternative services or if the User refuses all proposed alternatives, the User may claim a refund of any monies paid, as well as compensation for any additional damages they may have suffered as a result of the cancellation under the terms of article 3.5.9.

Bey Tours may also terminate the contract and reimburse the User in full for any payments made, but may not be required to pay additional compensation if Bey Tours has been unable to fulfil the contract due to Exceptional and Unforeseeable Circumstances as defined in article 3.5.7, and shall notify the customer of the termination of the contract as soon as possible before the start of the travel or the trip.

3.5.5 Bey Tours' responsibility for the fulfilment of travel arrangements

Bey Tours is not the ultimate performer of the Travel Arrangements available on the Website. These Travel Services are performed by the Third Party Suppliers.

As a diligent operator, Bey Tours is responsible for selecting the Third Party Suppliers and for carefully managing the performance of their services.

The User must inform Bey Tours immediately of any failure or improper fulfilment of the services agreed in the package holiday to enable Bey Tours to resolve any issues before the end of the stay. Bey Tours shall not be obliged to resolve any issues if it proves impossible to do so or if the cost involved is disproportionate to the extent of the failure and to the value of the relevant travel arrangements. In the latter case, the User shall be entitled to a price reduction or compensation in accordance with article 3.5.9.

Where a significant proportion of the travel arrangements cannot be provided as agreed in the contract, Bey Tours will offer, without additional cost to the User, other appropriate services, if possible of equal or higher quality than those specified, for the continuation of the contract.

When the alternative services offered by Bey Tours result in a trip of a lower quality than initially agreed, the User may request a Price reduction under the terms of article 3.5.9.

The User may only refuse the other proposed services if they are not comparable to those agreed in the contract or if the price reduction allocated is not appropriate. If the User refuses the alternative proposals or if Bey Tours is unable to provide them, the User is entitled to a Price reduction and/or compensation under the terms of article 3.5.9.

In the event that non-compliance significantly disrupts the fulfilment of a trip or stay and where Bey Tours cannot resolve it within a reasonable time frame, the User may either continue their trip or terminate the contract with no cancellation fees and request, if applicable, a price reduction and/or compensation in accordance with article 3.5.9.

Should the User decide to terminate the contract and if the Package Holiday includes transport, Bey Tours shall ensure repatriation of the User by an equivalent means of transport, as soon as possible in respect of the current circumstances and without additional costs to the traveller, who will be entitled to a Price reduction and/or compensation under the terms of article 3.5.9.

When it is impossible, due to Exceptional and Unforeseeable Circumstances, to ensure the traveller's return as agreed in the contract, Bey Tours will bear the cost of the necessary accommodation, if possible of equivalent standard, for a maximum of three nights per traveller.

The cost limitation provided for in the previous paragraph shall not apply to persons with reduced mobility, as defined in Article 2(a) of Regulation (EC) No. 1107/2006, to any persons accompanying them, to pregnant women, unaccompanied minors, or persons requiring specific medical assistance, provided that Bey Tours has been informed of their special needs at least 48 hours before the start of the contract.

If a longer period than that mentioned above is provided for in the European Union's legislation on passenger rights for the relevant means of transport applicable to the passenger's return journey, or if these rules do not allow the transport supplier to limit its obligations as defined above in the event of Exceptional and Unforeseeable Circumstances, then the limits established by such laws shall apply.

3.5.6 Specific Conditions of Third Party Suppliers

Bey Tours works in partnership with Travel Service Providers such as airlines or accommodation services, but Bey Tours has no control over these Providers. The Services are subject to the Travel Service Providers' specific Terms and Conditions, which are made available to the User prior to booking.

3.5.7 Force majeure and Exceptional and Unforeseeable Circumstances

When reference is made in these General Terms and Conditions of Use to the term Exceptional and Unforeseeable Circumstances, as mentioned in Article L 211-2 of the French Tourism Code, it refers to a situation beyond the control of the party invoking such a situation, and the consequences of which could not have been avoided even if all reasonable measures had been taken.

This includes, for example, warfare or other security problems such as acts of terrorism, significant risk to human health such as the outbreak of epidemics at the User's destination, natural disasters such as floods, earthquakes or weather conditions that make it impossible for the User to reach the destination with reasonable safety. Bey Tours may, in particular, refer to advice from the Ministry of Foreign Affairs on international situations.

3.5.8 Difficulties during the trip

3.5.8.1 Assistance when the User is in need

Bey Tours will provide the necessary assistance in case of difficulty, in particular by providing information on health services, local authorities or consular assistance and by helping you make long-distance communications and find alternative travel arrangements. Bey Tours does not normally charge for this assistance although it reserves the right to do so if the difficulty was caused by the User through their own negligence or intentionally.

3.5.8.2 Resolving disputes at the site of their stay

If a problem should occur during your stay, you must immediately notify both Bey Tours (via the contact details set out in your booking confirmation or below) and the Third Party Supplier responsible for the services (e.g. the accommodation service), who will endeavour to resolve the dispute. It is important that both entities be informed promptly in order to enable them to implement the necessary measures to resolve the problem.

However, if your complaint cannot be resolved on site, please forward this to us within 30 days of your return by sending a concise email, clearly indicating the booking reference for the relevant service.

You can also access the European Commission's Online Dispute resolution platform at https://ec.europa.eu/consumers/odr/. This platform provides a means of registering a claim, without prejudice to the terms of resolution.

 

3.5.9 Price reduction and compensation

The User is entitled to an appropriate price reduction for any period of non-conformity of the services as prescribed in the contract, unless the non-conformity is attributable to the User.

If Bey Tours cannot remedy the non-compliance within a reasonable time frame established by the User, the User may resolve the issue themselves and claim reimbursement of the relevant costs. The User does not need to specify a time frame if the organiser or retailer refuses to resolve the non-compliance or if an immediate solution is required.

3.5.10    Limitation of liability

The User is entitled to compensation for any damage suffered as a result of the non-compliance of the agreed upon services, unless the non-compliance is attributable to:

- the traveller,

- a third party unconnected to the provision of the travel arrangements included in the contract,

- Exceptional and Unforeseeable Circumstances relating to a situation beyond Bey Tours' control, the consequences of which could not have been avoided even if all reasonable measures had been taken.

Bey Tours shall not be liable to compensate the User as part of their Package Holiday in the event that international agreements limit the extent or conditions under which compensation should have been paid by a Third Party Supplier.

Formalities

All the requirements in the Formalities clause in article 2.3 above shall apply to the booking of travel packages.

3.6 Insurance

No insurance is included in the prices offered on the Website. Users are therefore recommended to take out insurance covering the consequences of certain cases of cancellation and an assistance agreement covering certain specific risks, including repatriation costs in the event of accident or illness.

Article 4: Financial conditions and means of payment

Unless specifically stated to the contrary in the Specific Conditions, the prices of the Services provided on the Website shall be given in euros or in local currency, net of charge and without any local taxes imposed by the authorities of certain third countries.

The price of the Services is as shown on the Website, except in the event of obvious error. Prices are subject to change at any time, but these changes will not affect bookings that have already been accepted, except in the cases mentioned in article 3.5 above. Bey Tours may in some cases apply booking fees for certain airline services requested by the User. The User will be notified of all applicable fees at the time of booking. Despite Bey Tours' best efforts, the price of certain Services listed on the Website may be incorrect. BEY TOURS EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY INCORRECT PRICES ON ITS WEBSITE AND/OR FOR INCORRECTLY PRICED BOOKINGS. IN THIS CASE, AND SUBJECT TO AVAILABILITY, BEY TOURS WILL OFFER THE USER THE OPTION OF KEEPING THEIR BOOKING AT THE CORRECTED PRICE OR WILL CANCEL THE BOOKING WITHOUT ANY PENALTY. Bey Tours has no obligation to provide Services to a User at an incorrect (lower) price, even if the User has received a booking confirmation to this effect.

Unless otherwise stated in the Specific Conditions of the Third Party Suppliers concerned, payments made on the Website shall be made by bank card (credit cards, Visa, Eurocard/MasterCard are accepted) via a secure system.

The costs and the service fees shall relate to the costs relating to the Services ordered by the User, incurred by the Third Party Suppliers. They include in particular indirect taxes (VAT and other similar taxes) and other costs which are necessary for the processing of User reservations.

Amounts paid for prepaid accommodation services ("pay online now") include:

  • on the one hand, taxes for which Bey Tours is personally liable in respect of its own activity (for example, VAT or any other similar turnover tax),
  • on the other hand, taxes applicable to accommodation services (e.g. turnover tax, VAT, tourist tax, accommodation tax, indirect taxes and excise duty, etc.) that Bey Tours repays to Third Party Suppliers, with the latter being required to pay them to the competent authorities. The amount of these taxes is determined by the Third Party Suppliers. Unless otherwise provided by law, Bey Tours is in no way responsible for any discrepancy that may arise between the amount of fees charged for the transaction on the Website and the one repaid to Third Party Suppliers, which may vary depending on the country, the different regions of a same country, specific exemptions or the dates of your stay.

 

In addition, accommodation services located in New York City, sales tax in New York State, as well as tourist taxes on accommodation services in New York City are due both on sums received by the accommodation services for reserving the room and on the amounts taken for accommodation products and services. For accommodation services located in New York State, but outside New York City, sales tax for New York State shall be due both on sums received by the accommodation service for reserving the room and on the amounts received for accommodation products and services. In addition, for accommodation services in New York State, but outside New York City, costs related to taxes and charges in the accommodation service are charged in order to cover the local accommodation duties owed on the price charged by the accommodation service for the room. Sales tax in New York State and the charges for New York City owed on both the room reservation price and on accommodation products and services, and the corresponding charges applicable to accommodation fees and charges, are included in the category ‘Fees and commissions’ on the Website and in the ‘Taxes’ category on the invoice confirming your reservation.

For online prepayment reservations, the registration certificates and tax numbers in New York State and New York City for Third Party Suppliers are set out below. New York State and New York City have amended their laws and require that the User be informed of these provisions.

Tax registration in New York State

Sales tax in New York State and holiday tax in New York City, if applicable, shall be payable for the entire duration of your stay. For accommodation services reserved and paid in advance, the Third Party Supplier’s tax number for New York State for sales tax is 880392667 and its tax number for New York City for the holiday tax is 033960.

Payments

The price of the Services booked on the Website or by telephone is paid (i) to Bey Tours or to its TPX supplier, which accepts these payments on behalf of the Third Party Suppliers, and/or (ii) directly to the Third Party Suppliers. Payment may be made to more than one party (as shown on the User's bank statement or credit card statement), however the total amount received will not exceed the total price of the Services.

The User will have to provide details of their payment card and the Third Party Supplier or Bey Tours will often have to check: (i) the validity of the payment card (through fees of a nominal value that will either be refunded within the following days or deducted from the final payment due to the Third Party Supplier) and (ii) the availability of funds on said payment card (confirmed by the bank that provided the User's payment card).

Third Party Suppliers remain responsible for invoicing services paid directly to them. Bey Tours may only issue an invoice for Services booked on the Website or by telephone and paid to Bey Tours or to its TPX supplier.

Debit and credit card fees

Some banks or credit cards impose fees for international transactions. If you make a reservation from a country other than France with a French credit card, your Bank may convert the amount of the payment in your local currency and charge you exchange fees. This means that the amount detailed on your credit card or bank statement may be in your local currency and, consequently, can be of a different amount to that shown on the payment summary for the reservation carried out on the Website.

In addition, foreign transaction costs may be imposed if the bank which issued your credit card is located outside France. Reserving an international trip may be considered an international transaction by the bank or credit card company, and Bey Tours may pass your payment to an international travel provider. The exchange rate and foreign transaction costs are only determined by your bank on the day on which the transaction is carried out. If you have questions about these costs or the exchange rate used in your reservation, please contact your Bank.

Third-party payment options

In addition to the standard payment options available for any booking made through the Website, Bey Tours may list, amongst others, "payment by instalments" options or any other credit or financing for a reservation. These options are generally offered by Third Party Suppliers on terms and conditions that are not established by Bey Tours (or any of its affiliates). Any questions, claims or disputes relating to these payment options must therefore be submitted directly to the relevant Third Party Suppliers who proposed them. The Specific Conditions applicable to these payment options are made available before making a reservation.

Article 5. User Services and complaints

In accordance with the provisions of Article L.121-34 et seq. of the French Consumer Code, consumers who do not wish to be subject to marketing by telephone can be placed for free on a do-not-call list. When our services gather your telephone details, you will be informed of your right to be added to the do-not-call list.

5.1 Contacting beytours.pro advisers

Customer service:

In the event of any change or cancellation of a trip already purchased, the User may contact beytours.pro advisers by telephone from Monday to Friday between 10 am and 6 pm and on Saturdays and Sundays from 10 am to 3 pm:

  • on 01 40 22 04 20 in mainland France (cost of a local call),
  • on +33 1 40 22 04 20 from a land line phone abroad (cost of an international call, depending on the place of the call)

Reservations:

Beytours.pro advisers can be reached by telephone from Monday to Friday from 10 am to 6 pm and on Saturdays and Sundays from 10 am to 3 pm:

  • on 01 57 32 49 86 (price of a local call in mainland France),
  • on +33 1 57 32 49 86 from a landline phone abroad (cost of an international call, depending on the place of the call)

The User may send an email via the "Customer Assistance" section of the Website or to the following address contact@beytours.com, provided they can prove their identity.

5.3 Complaints service

Any request for information, details and any potential complaint should be sent to Bey Tours, which collects such information on behalf of Third Party Suppliers, within 30 days following the end of the trip:

  • by telephone to the following number: 01 40 22 04 20 

Complaints will be admitted only where the difficulties to which they relate have been indicated to Bey Tours or to the Third Party Supplier during the trip so that an attempt could be made to rectify the situation to limit the damages suffered by the User. However, exceptions will be possible, depending on the circumstances.

No complaints shall be accepted for the loss, damage or theft of luggage, clothing or personal possessions under supervision of the User during the duration of the trip, unless the liability of Bey Tours or its Third Party Suppliers can be proven. Baggage checked in with an airline shall only be insured for the duration of the transport.

Article 6. Liabilities and guarantees

Unless otherwise stated by law, Bey Tours may not, in any case, be held liable in relation to the Services contracts that the User concluded with one or more than one Travel Service Provider and, in particular, when the damage is caused by the User, by a third party outside the provision of services given in the agreement, or owing to a case of force majeure.

Article 7. Data protection

The information submitted by the User on the Website enables reservations to be made and dealt with.

The Privacy Policy is available on the Website, detailing all the provisions relating to the protection of personal data. In the event of any inconsistency between these General Terms and Conditions and the Privacy Policy, the latter shall prevail.

In accordance with Article 32 of the Law on IT and Freedoms of 6 January 1978, as amended by law 2004-801 of 6 August 2004, the information needed for dealing with and making reservations shall be indicated by an asterisk on pages of the Website.

Other information requests are optional, and information relating to offers which may interest the User to the offers that may be sent to them are intended to increase the awareness of and improve the services to be provided.

Unless the User objects, Bey Tours may communicate this optional information concerning the User to companies within its group, including companies outside the European Union and particularly in the United States. The User specifically consents to this transfer.

Bey Tours may send the User information by any means (email, letter, SMS, etc.) enabling them to better understand and use their respective website, to benefit from promotional offers provided on these websites and to provide offers from Third Party Suppliers, in full respect of the provisions of the law "ensuring trust in the digital economy" and the law on "IT and freedoms", as amended, subject to the prior consent or refusal from the User, in the cases referred to in the Privacy Policy provided on the Website.

Furthermore, Bey Tours will provide its insurer with information relating to the User’s reservation. This enables Bey Tours to fight against bank card fraud.

In accordance with the French law on IT and Freedoms of 6 January 1978, as amended, Users have the right, at any time, to access, amend, rectify and delete data relating to them. The User may exercise this right by sending an email from the "Customer Assistance" tab on the Website or to the following address: contact@beytours.com.

Article 8. Applicable law and mediation

The General Terms and Conditions are subject to French law. Any dispute relating to their interpretation and/or their implementation shall come before the French courts.

Please note that in the event of a dispute between yourself and Bey Tours, you have recourse to a conventional mediation procedure or any other alternative dispute resolution measure, as defined in French law and in particular Articles 1528 et seq. of the French Code of Civil Procedure.

The consumer ombudsman to which Bey Tours is answerable is the tourism and travel Ombudsman (http://www.mtv.travel/). After having submitted a written complaint to Bey Tours' complaints department, and provided that you have not received a satisfactory response within 60 days, you may submit your complaint to the Tourism and Travel Ombudsman, under the terms and conditions set out on the Ombudsman's website. Article 9. Final provisions

The failure of Bey Tours to uphold, at any given time, one of the provisions of the General Terms and Conditions shall not be interpreted as a waiver by itself to invoke at a later stage one of these provisions.

In the event that one of the provisions of the General Terms and Conditions is declared invalid or without effect, this provision shall be deemed to have not been written. This does not affect the validity of the other provisions, except if the provision declared invalid or without effect was essential and decisive.

Any cases of force majeure suspend the obligations of any of these General Terms and Conditions affected by the case of force majeure and exonerate the party which would have had to fulfil the affected obligation.

Standard information form for Package Holiday contracts

In accordance with its legal and regulatory obligations, prior to entering into a contract with the User, Bey Tours will send the User a form containing any mandatory and appropriate pre-contractual information for the proposed contract, as well as a summary of the User's rights based on the model set out below:

Essential rights under Directive (EU) 2015/2302 incorporated into the French Tourism Code:

- You will receive all the essential information via the Bey Tours website with respect to the Package Holiday before entering into the Package Holiday contract.

- Bey Tours is responsible for the proper fulfilment of all travel arrangements included in the contract.

- For the emergency telephone number / contact details for your point of contact, please contact: Customer Services email: contact@beytours.com or by calling 01 40 22 04 20 

- You can transfer the package to another person, upon reasonable notice, but this may be subject to additional fees. Please call our customer service for further information: 01 40 22 04 20

- The price of the Package Holiday may only be increased if specific costs increase (e.g. fuel prices) and if expressly provided for in the contract. This may not be changed less than 20 days prior to the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction if there is a decrease in the relevant costs.

- You can terminate the contract with no cancellation fee and be fully reimbursed for any payments made if any of the key elements of the package, other than the price, undergoes a significant change. If, prior to the start of the Package Holiday, it is cancelled by Bey Tours, you will be entitled to a refund and compensation, where applicable.

- You may terminate the contract without paying a cancellation fee prior to the start of the Package Holiday in exceptional circumstances, for example relating to serious security issues at the destination that may affect the Package Holiday.

- In addition, you may, at any time prior to the start of the Package Holiday, terminate the contract by paying an appropriate and justifiable cancellation fee (which may be equal to the cost of the Package Holiday).

- If, after the start of the package, significant elements cannot be provided as agreed, appropriate alternative services will be offered to you, at no additional charge. You may terminate the contract with no cancellation fee if the services are not fulfilled in accordance with the contract, thus significantly disrupting the fulfilment of the package, and if we do not resolve the problem.

- You are also entitled to a price reduction and/or compensation in the event of non-fulfilment or improper fulfilment of travel arrangements.

Standard information form for linked travel arrangements

If you book additional travel arrangements for your trip or stay via Bey Tours, you will NOT benefit from the rights applicable to packages under (EU) Directive 2015/2302 and Article L.211-2 of the French Tourism Code.

Bey Tours will not be responsible for the proper fulfilment of these additional travel arrangements. In case of any issues, please contact the relevant service provider.

However, if you book any additional travel arrangements from Bey Tours during the same visit to the website, these travel arrangements will become part of a linked travel arrangement.

In such cases, Bey Tours has, as required by European Union law, coverage to refund the sums you have paid for services that have not been fulfilled due to insolvency. Please note that in such cases, there will be no refund in the event of insolvency of relevant additional service providers.

If the service provider reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.

- You may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the contract, other than the price, are changed significantly. If before the start of the service we cancel said service, you are entitled to a refund and compensation where appropriate.

- You may terminate the contract without paying any termination fee before the start of the service in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the travel.

- Additionally, you may at any time before the start of the travel terminate the contract in return for an appropriate and justifiable termination fee (which may be equivalent to the cost of the travel).

- If, after the start of the travel, significant elements of said travel cannot be provided as agreed, suitable alternative arrangements will be offered to you, at no extra cost. You may terminate the contract with

out paying any termination fee, where services are not performed in accordance with the contract, where this substantially affects the performance of the travel and that the service provider fails to remedy the problem.

- You are also entitled to a price reduction and/or compensation for damages where the travel arrangements are not performed or are improperly performed.
